Ledford's attorneys had argued execution by Georgia's lethal injection drug was likely to cause him extreme pain in violation of his constitutional rights.

Lawyers for a Georgia inmate scheduled to be executed Tuesday has filed an appeal with the U.S. Supreme Court arguing that it is wrong to sentence an offender less than 21 years old to death.

His lawyers say gabapentin alters a person's brain chemistry by making brain receptors more receptive to the drug and less receptive to other drugs, including pentobarbital.

Ledford's lawyers are still try to get Ledford a reprieve and have filed notice of their intent to appeal to the 11th u.s. circuit court of appeals. They questioned the timing of his request. If conducted as planned, the execution will be the first in the Peach State this year.

Later, neighbor Ledford forced his way into the home at knifepoint, and demanded money and guns.

Georgia does not use firing squads for executions.

For his final meal, Ledford requested filet mignon wrapped in bacon with pepper jack cheese, large french fries, 10 chicken tenders with sauce, fried pork chops, a blooming onion, pecan pie with vanilla ice cream, sherbet and a Sprite, according to WGLC.

Georgia state lawyers disagree, claiming there is "no substantial risk" for him to experience pain despite his claim of having extended exposure to gabapentin.

Ledford's lawyer has stated that he will now be appealing to the Supreme Court.

Lawyers for the state said the argument that Ledford was too young to be sentenced to death had not been raised before.

Ledford's lawyers have admitted they don't expect the inmate's request to succeed, according to CNN.

Ledford told police he had a number of beers and smoked a couple joints in the hours before the killing.

Ledford was 20 when he killed the doctor, and his attorneys asked the state panel to consider his age and his intellectual disability when deciding whether to spare his life.

In the court documents, the Georgia attorney general's office calls that statement speculative and says the 5,000 mg of pentobarbital used in Georgia executions is more than enough to prevent Ledford from feeling pain.

"The Georgia legislature is free, within the parameters established by the United States Constitution, to choose the method of execution it deems appropriate", a three-judge appellate court panel said in the decision. "The inmate was pronounced dead two minutes after he was shot".

A Georgia man is set to be executed Tuesday for the 1992 murder of his neighbor during an armed robbery.
